Terms and Conditions of Sale

1. Who these terms apply to

These terms apply to every order placed through cedarplanters.nl by a consumer — a natural person acting outside their trade, business, craft or profession. Business customers and retailers buy under separate terms; contact info@cedarplanters.nl.

Nothing in these terms limits or excludes the rights you have under mandatory consumer law. Where a term conflicts with those rights, your legal rights prevail.

3. How a contract is formed

  • Product listings are an invitation to order, not a binding offer.
  • When you complete checkout and confirm the order, you make an offer to buy. The order button is labelled to make clear that placing the order creates an obligation to pay.
  • We send an acknowledgement of receipt immediately. This is not yet acceptance.
  • The contract comes into existence when we send you the order confirmation, or when we dispatch the goods, whichever happens first.
  • If we cannot accept your order — for example the item is unavailable or a price was clearly wrong — we will tell you promptly and refund any payment in full.
  • We store the text of the contract and send it to you with the confirmation, together with these terms and the withdrawal form, on a durable medium.

4. Prices and payment

  • All prices are shown in euros and include VAT. The rate that applies is the rate of the country your order is delivered to, so the VAT contained in the price differs between countries. The VAT amount is shown separately in the checkout summary and on your invoice.
  • Delivery is free to every country we ship to. The price you see is the total you pay: no shipping charge, no surcharge for any payment method, and nothing payable on receipt.
  • For deliveries within the EU, goods are shipped delivered duty paid: there are no customs charges, import duties or handling fees payable by you on receipt. We import into the Netherlands as importer of record under our Article 23 licence and account for the VAT ourselves.
  • We accept credit card, PayPal and Shop Pay. Payment is taken at the time the order is placed. We do not charge any fee for using a particular means of payment.

5. Delivery

We deliver to the countries listed at checkout, free of charge, from our fulfilment centre in Hoofddorp, the Netherlands. Your order arrives within 3–7 business days in the Netherlands, Belgium, Luxembourg and Germany, and within 3–10 business days elsewhere. In any event we will deliver within 30 days of the contract unless we have agreed a longer period with you.

If we miss the delivery date, you may set us a reasonable additional period. If we still fail to deliver, you may cancel the contract and we will refund everything you have paid without delay. Where the delivery date was essential and you told us so, you may cancel immediately.

Risk of loss or damage passes to you when you, or someone you have named, takes physical possession of the goods.

6. Your right to change your mind

You have 14 days from the day you receive the goods to withdraw from the contract without giving any reason, and we pay the return shipping. Full details are in our Returns and Right of Withdrawal policy, which forms part of these terms.

7. Conformity and guarantees

We must deliver goods that conform to the contract. You are entitled to the legal guarantee of conformity for a period of at least two years, and under Dutch law for as long as you may reasonably expect the goods to last given what we have told you about them. We also give a voluntary commercial guarantee, which is additional to and never in place of your legal rights. See our Guarantees page.

8. Our liability

We are liable for foreseeable loss and damage caused by our failure to comply with these terms or by our negligence. We do not exclude or limit our liability in any way where it would be unlawful to do so, including liability for death or personal injury, for fraud, for gross negligence or intent, or under product liability law.

We are not liable for business losses. If you use the goods for any commercial purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

9. Complaints

Please contact info@cedarplanters.nl. We acknowledge within 2 working days and aim to resolve within 14 days.

10. Changes to these terms

We may change these terms for future orders. The terms that apply to your order are the ones published when you placed it, and we send them to you with your confirmation. We will not change the terms of an order after you have placed it.

11. Governing law and competent court

These terms and your purchase are governed by the law of the Netherlands.

If you are a consumer resident in another country of the European Union or in Switzerland, you also keep the benefit of any mandatory consumer protection rules of the country where you live, and this choice of law does not deprive you of them.

You may bring proceedings in the courts of the Netherlands or in the courts of the country where you live. We may bring proceedings against you only in the courts of the country where you live.
